Porsche 356 Registry Litigation: Update?

  • Mr. Staggs, It matters not what percentage of the subscribers to the magazine approve or disapprove of. Popularity is not the criteria to be met, especially popularity borne of ignorance. It is, however, adherence to the rule of law and the inclusion of all who wish to participate in a 'non profit' organization. Commenting from a position taken of being above the fray and thereby on the 'high ground' has no meaning to those on the ground engaged in the conflict.

    • Psych 101.....when in an open and rather 'public' forum with potentially adversarial situations/conversations/comments, avoid the leading accusatory word of "you" and couch expressions or points of view with "I". "I feel that the author of a good new Porsche book should have no disparagement from overlapping issues if those issues are unrelated to the book...as recently explained here by said author."

      Then, in private communication, the norm is to use "f-'em" on either side when referring to the other side. Knowing the original protagonists 'over there' for a very long time, even calling most of them friends and doing business with several, I know they are not choir boys and neither am I. That's fine unless it involves the running of a 7,000 member club. Then, the personality of NO ONE must not get in the way and it has to be dotting of 'i's' and crossing of the 't's' 'business.'

      However, it's been about 60 years since I've witnessed (and admittedly participated in) such playground behavior as what precipitated Steve's suit(s). Things have become so divided and out of control for so long, it's a wonder more 356ers aren't saying "Enough already...really, what's all this about, anyway?"

      I wonder how many here or in the Registry would be interested in a short fact sheet (not a boring manifesto) of the few simple things that have caused this schism? To be sure, it will be short and plain and therefore it will NOT be a "Cliff's Notes."

      • To start off with, my most recent post on this topic has been somewhat misunderstood, probably due to poor communication on my part. I apologize and will try to clarify my thoughts. I am sickened by the way that some R members and some posters on other forums, including but not limited to abcgt, treat others that have differing opinions with attacks and denigration. "Taking the high road" means refraining from that type of behavior, despite the source. It does not mean turning a blind eye to inappropriate behavior, moral, ethical, legal, or other issues. I STRONGLY feel that everyone should have the opportunity to express their positions and opinions in a civil and appropriate way. Terms like "trustmees", etc... have no place in discussions of differing opinions among adults. Like Bruce said, we're not school kids.
        I hope this helps clarify the intentions of my prior post

        • The term 'Trustmes' is derived from the leadership of the 356 Registry's response to those who asked to see the books and records, as required by law.
          It was 'we don't need to show you anything, just trust us'. It is quite appropriate, not profane or otherwise offensive, just an accurate description of those being addressed.

              • New trial date is set for Jan 27, 2015. No other extensions to be granted. Of course, whatever the outcome of that trial, there may be more appeals so don't hold your breath waiting for a 'final' resolution. That of course, doesn't account for any action the IRS may take in the interim. Are we having fun yet? My question has always been, ' If the Trustmes are doing an exemplary job, as they state, why not simply reveal their records, as required by law, and put an end to all of this ? ' Or, If you have nothing to hide, why are you spending so much time, effort and subscriber's money trying to conceal your good works ?
                Anyone got an answer that makes sense ?

                  To my knowledge nothing occurred on November 14 nor was anything scheduled for that date. On November 17, the last-scheduled trial date, the court granted the plaintiff's motion to continue trial. Trial is now scheduled for January 27, 2015. There are motions of various sorts and an appeal pending also. Stay tuned.

                  • Perhaps it would be helpful to reflect upon what a trustee is, or is supposed to be. One universally (and legally) recognized concept follows:

                    "A trustee is a fiduciary of the trust beneficiary. A fiduciary is legally bound to act, within the confines of the law, in the best interests of the beneficiary. A trustee is in a special position of confidence in relation to the beneficiary because the trustee has control of property that is essentially owned by the beneficiary."

                    It is fundamental, in all of American jurisprudence, that a trustee sets aside his/her own interests in favor of all of the beneficiaries whom that trustee represents.

                    For at least four years the Trustees of 356 Registry, Inc., with the notable exception of Al Zim in the past and currently as best I can tell Felix Macaluso, have ignored or worse, abused that trust. Hence those individuals were and are undeserving of the term "trustee."

                    Although amongst "us boys" I have used locker room terms that the "trustees" have earned, in my opinion, by lying to and about me and others, the term "trustme" is not particularly offensive to me and considerably less so than the language used by many posters on the Registry forum. Those outbursts are, unfortunately, tacitly and in all too many instances publicly approved by the "trustees."

                    You have to call them something and trustee is not appropriate when applied to the majority of the current occupants of that office. Too many of them have abused their trust. I seriously respect my friends Jack, David and Trevor and because of that respect will abridge somewhat any intemperate remarks I might otherwise have made. I'll try anyway.

                    Finally, I was looking for a quote on the Registry forum on another, but related, topic. For your amusement, I present the following - a little levity to brighten your day, I hope. You can't make this stuff up. Life is better when comedy writes itself as this did about three days after the author first used "the accusers" to characterize me and others with whom he evidently disagreed.

                      Thanks, as usual, for your updates on the lawsuit. I must say that the wheels of justice turn slowly. Glaciers move quicker.

                      As for the term "trustmes", when first used it made a point with clever and humorous sarcasm. I approved. But continued and constant use wears it thin, just as Mr Murray does on the R site with his constant "Rosemary" jabs. Two wrongs don't make a right.

                      As you note, discussions on Justin's largely un-moderated site are remarkably civil. We should all endeavor to keep it that way, regardless of what may transpire over on the "other" site. Take the "high road", just as Mr. Heinrichs has with the membership list he now has. Is it interesting that we have not seen any mention of this on the R site?

                      That little post from Mr. Murray is priceless. What irony! I've gotten myself in trouble too many times responding to his posts. Decided just to ignore him from now on, hard as that may be. I would assume others feel the same. Its a terrible old cliche, but that old bit about wrestling with the pig comes to mind.

                        Just a few hours before your remembrance I advised a friend who remains an R member, NOT to respond to one of Cliff's droppings that would annoy most humans quoting exactly the admonition against pig wrestling. There is another version of that by the way - no surprise really. Don't argue with an idiot. He will drag you down to his level and then beat you with experience. It's hard to remember these sensible warnings at all times but I try.

                        Speaking of pigs, a blind pig, me, happened upon an acorn, the quote I posted. Rich irony indeed.

                        Happy Thanksgiving to you and yours. The kitchen is going to be at redline for several days. My favorite holiday. Do enjoy yours.

                              • Nice to hear from you Brian. Hope all is well. We're headed to Santa Cruz to celebrate my daughter's birthday with her but will wave on our way by Saturday.

                                If the case stays on schedule I'd expect the trial court judgment in early February. The case will be tried to a jury.
