Porsche 356 Registry Litigation: Update?

  • I urge anyone interested in this to take the time to read this latest complaint. It provides some detail as to chronology, involved persons, and motivation. Reading this answered many questions that have been asked recently (keeping in mind that this is only one side of the story).

    In order to see the fuller picture, one must read the entire document. For a legal complaint, it's not a bad read. Bill's link to the PDF works, but you must be registered on this forum to download it.

    • I'll try to summarize the complaint in case anyone is interested when I get back from a car show on Tuesday.

      Right now I'm loadin up my woodie with the boards inside settin out singin a song. Come on baby surfin safari . . . With apologies to the Beach Boys for butchering their lyrics.

          I want to thank a number of you who have both called and sent emails of support. I am appreciative and it seems there is more support for shaking trees and other actions than I would have guessed or even hoped.

                  • For those interested, here is the appellate court opinion. The motion of Steve Heinrichs to dismiss the appeal without a hearing because the order appealed from was not appealable was denied. The Court of Appeal then decided the appeal itself in favor of Heinrichs and against 356 Registry, Inc. and awarded to Heinrichs his costs which will be paid by the Registry, the loser on appeal.

                    The "personal" accusations in the counter-claim filed by the Registry against Heinrichs appear, at least to me, to have been a factor in the court's decision, but reach your own conclusions. Unless the Registry delays matters further by seeking a hearing in the Ohio Supreme Court the matter will be returned to the trial court for proceedings consistent with the opinion and judgment rendered. Absent that delay discovery will proceed on both sides, motions will be filed and a trial will be held.

                    • Reading through this link that Bill posted I realize even more why this country is so screwed up. I love it here & would not want to live anywhere else but this system is wacky in that nothing gets done in a timely manner. I understand Steve's point of just wanting to see the books. I'm an outsider & to me it looks like the Registry is doing all they can to hide something, if they aren't then just open it up for an audit.

                      Back to ,imo, the screwed up system. Why does it take spending hundreds/thousands of hours/dollars just to get to this point & we are still a year away from a trial start? I understand there needs to be laws/rules to protect everyone but wow this is ridiculous.

                      Maybe someone should post this link on the thread over there titled " Predicted Demise of Registry Forum - How Now?" I would but I decided to keep my $45 to spend on my car & not on lawyers/courts.

                      The more I read about this the more I get turned off by these people who are in charge.

                        • Agreed X 2. It does appear illogical in the extreme not to willingly share meeting minutes and finances regularly and completely with the membership. It reminds me of Lois Lerner of the IRS: "I did nothing wrong but refuse to incriminate myself by answering your questions."

                              Now, if I were able to exercise my membership rights as I should be able to (see federal lawsuit) I would post a query on the Forum asking why the members' only section regarding the lawsuit status had not been updated.

                              And---where are the promised minutes and audit and when does president Dunn re-explain the need for a dues increase since the columns were flipped and the loss he explained was a profit. Or, was it really.

                                So, importantly, the Registry and its Trustees and appointed officers, continue to ignore reality and to avoid explaining the possible effect of litgation on them and the club, despite their fiduciary responsibilities. Maybe, and it would not surprise me, They are preparing a full frontal assault.

                                Is that what this is all about, Mr. Bosch?

                                I mean---why should They be so secretive? Why should They spend Registry money to deny access to information? You are a member. Help me please understand, Jerry.

                                Really, seriously, why???
